This Intellectual Property Policy outlines the obligations and responsibilities of both VegaVend and its Vendors in relation to intellectual property rights.

Definitions:

Intellectual Property (IP)

Includes but is not limited to trademarks, copyrights, patents, trade secrets, and any other proprietary information.

Infringement

The unauthorised use, reproduction, or distribution of someone else’s IP.

VegaVend’s Commitment:

Respect for IP Rights

VegaVend respects the intellectual property rights of all brand owners and creators. We are committed to removing any infringing content from our platform.

Support for Rights Holders

We provide a process for rights holders to report alleged IP infringements, and we promptly investigate and take appropriate action on such reports.

Vendor Responsibilities:

Original Content

Vendors must ensure that all product listings, images, descriptions, and any other content uploaded to VegaVend are original or used with proper authorisation.

Compliance

Vendors must comply with all applicable IP laws and regulations, and must not list or sell products that infringe on the IP rights of others.

Proof of Rights

Upon request, Vendors must provide evidence of their rights to use any IP associated with their listings, such as licences or written permissions.

Prohibited Actions:

Infringement

The listing or sale of products that infringe on the IP rights of others is strictly prohibited.

False Claims

Vendors must not falsely claim ownership of IP that does not belong to them.

Non-Compliance

Failure to comply with this policy may result in removal of listings, suspension, or termination of Vendor accounts.

Reporting IP Infringements:

Rights Holders

IP rights holders who believe their rights have been infringed can submit a report to VegaVend through our online reporting system or by contacting us at ip@vegavend.com.

Required Information

Reports should include sufficient detail to identify the infringing content, proof of ownership of the IP, and a statement of good faith belief that the use is unauthorised.

VegaVend’s Enforcement Actions:

Investigation

Upon receiving a report of alleged IP infringement, VegaVend will conduct a thorough investigation.

Actions

If an infringement is confirmed, VegaVend may remove or disable access to the infringing content, and take further actions against the Vendor, including warnings, suspension, or termination of the account.

Notification

Vendors will be notified of any action taken against their listings and will have the opportunity to appeal the decision.

Appeals Process:

Right to Appeal

Vendors who believe their content has been wrongly identified as infringing can appeal the decision.

Submission of Appeal

Appeals must be submitted in writing, providing detailed reasons and any supporting evidence to appeals@vegavend.com.

Review Process

All appeals will be reviewed by our compliance team, and Vendors will be notified of the outcome within 30 days.

Education and Awareness:

Resources for Vendors

VegaVend will provide resources and guidance to help Vendors understand their obligations regarding IP rights and how to avoid infringement.

Ongoing Training

Vendors are encouraged to participate in training and stay informed about IP laws and best practices.

VegaVend is dedicated to fostering a marketplace that respects intellectual property rights and supports the creative efforts of all our Vendors and rights holders. By adhering to this Intellectual Property Policy, Vendors help maintain a trustworthy and legally compliant marketplace.
