Hazardous and Dangerous Items

Important: If you supply products for sale on VegaVend, you must comply with all laws, regulations and VegaVend policies applicable to those products and product listings.

Because VegaVend wants to ensure that products offered through VegaVend are safe (that is, there is no risk that they will cause death, personal injury or damage to property), listings for any products recalled by the manufacturer or by a government agency are prohibited. VegaVend also reserves the right to take into account recalls made by government agencies of other countries.

Products first made available in the UK on or before December 31, 2020, must comply with the following EU rules.

Products that are not safe are prohibited. All new toys and electrical equipment must be CE marked, and where applicable, come with either (i) a UK 3-pin plug, or (ii) a non-UK plug permanently fitted with a UK safety-approved conversion plug. All toys and electrical equipment, whether new or used, must be safe. You must have used and refurbished electrical equipment tested by an expert prior to listing to verify that it is safe.

When selling allowed hazardous and dangerous items, it is your responsibility to store and transport them properly and with all the necessary security measures that may be required.

Examples of permitted listings

If listing a permitted but hazardous item, Vendors must ensure they are shipping the item in compliance with all applicable laws, regulations and VegaVend policies.

- Magnetised material

- Rechargeable batteries

Examples of prohibited listings

- Products intended to come into contact with foodstuffs (including products in contact with babies and infants’ mouths) containing Bisphenol A (BPA)

- Items containing Chemicals that may damage the ozone layer, such as Carbon Tetrachloride

- Prohibited products and equipment mentioned in Annex III of the EU Regulation 517/2014 (F-Gas Regulation), including:
  - - Movable room air-conditioning equipment that contains Hydrofluorocarbons – HFCs (or their mixtures) with Global Warming Power (GWP) of 150 or more;
  - - Refillable and non-refillable containers for Fluorinated Gases (F-gases) used to service, maintain or fill refrigeration, air-conditioning or heat-pump equipment, fire protection systems or switchgear, or for use as solvents;
  - - Domestic refrigerators and freezers that contain HFCs with GWP of 150 or more;
  - - Fire protection equipment that contain either Perfluorocarbons (PFCs) PFCs or HFC-23;
  - - Technical aerosols that contain HFCs with GWP of 150 or more, except when required to meet national safety standards or when used for medical applications;
  - - Aerosol generators marketed and intended for sale to the general public for entertainment and decorative purposes, as listed in point 40 of Annex XVII to Regulation (EC) No 1907/2006, such as metallic glitter intended mainly for decoration or artificial snow and frost;
  - - Signal horns that contain HFCs with GWP of 150 or more.

- Any chemical substance or compound that is intended for commercial, industrial, or professional use only and is not available for general consumer purchase

- Products recalled by manufacturers

- Products recalled by governmental agencies, national or international, such as CPSC, NHTSA, FDA, USDA-FSIS, EPA

- Products listed on a RAPEX report as posing a serious risk to the health and safety of consumers

- Products made of chemicals without necessary registration on the REACH-List

- Poisons subject to Schedule 1A of the UK Poisons Act 1972

- Certain hazardous items, such as:
  - - Batteries or accumulators, including button cell batteries, that contain more than 0,0005 % of mercury by weight or more than 0,002 % of cadmium by weight, except portable batteries and accumulators intended for use in: emergency and alarm systems; medical equipment (excluding cell batteries in hearing aids that are prohibited); cordless power tools
  - - Toy crossbows that have the capability of shooting small, sharp projectiles (for example, toothpicks, pins)
  - - Explosives, such as gunpowder

- Explosive substances prohibited by local Laws and European Union legislation, including explosives precursors listed in Regulation (EU) No 2019/1148 as specified below, as well as other explosives precursors such as potassium permanganate:
  - - Acetone in concentrations > 35%, except for nail polish removers
  - - Aluminium powder in quantities ≥ 100g
  - - Ammonium nitrate in any concentration/quantity, except for instant cold packs containing concentrations < 16% w/w nitrogen in relation to ammonium nitrate
  - - Calcium ammonium nitrate in any concentration/quantityCalcium nitrate in concentrations > 35% and in quantities ≥ 5 litres/5kgs
  - - Hexamine in any concentration/quantity, except as a food ingredient, or in fuel or fire starter tablets or cubes
  - - Hydrogen peroxide in concentrations > 12%
  - - Magnesium nitrate hexahydrate in any concentration/quantity
  - - Magnesium powder in quantities ≥ 100g
  - - Nitric acid in concentrations > 3%
  - - Nitromethane in any concentration/quantity, except for nitro fuel containing this substance in concentrations < 30%
  - - Potassium chlorate in concentrations > 40%
  - - Potassium perchlorate in concentrations > 40%
  - - Potassium permanganate in quantities ≥ 1kg
  - - Sodium chlorate in any concentration/quantity
  - - Sodium nitrate in concentrations > 5% and in quantities ≥ 5 litres/5kgs
  - - Sodium perchlorate in any concentration/quantity
  - - Sulphuric (Sulfuric) acid in concentrations > 15%

- Fireworks (except category 1 fireworks), such as:
  - - Aerial bombs or shells
  - - Bangers or firecrackers
  - - Fountains
  - - Jumping Jacks
  - - Roman candles
  - - Sky Rockets
  - - Sparklers which state that they are for outdoor use only

- Kite strings that are intended for kite fighting

- Vehicle airbags and airbag covers

- Products containing thermite

- Products contaminated by radiation

- Liquid mercury and products containing mercury, such as:
  - - Manometers, sphygmomanometers, and other medical devices containing mercury
  - - Thermometers

- Products that include large quantities of magnetic balls or cubes, such as:
  - - Buckyballs
  - - Buckycubes
  - - Dynocube
  - - Magnet Balls
  - - Magnicube
  - - Neocubes
  - - Neocubix
  - - Nanodots

- Authentic or used antique or vintage military or WWI, WWII, or Cold War era gas masks, their filters and canisters

Products that are first made available in the EU or UK on or before December 31, 2020, can continue to circulate until they reach their end user and do not need to comply with the changes that take effect from January 1, 2021. You can retain evidence of when products were first made available in the UK or EU by keeping documents including contracts of sale, invoices and documents concerning the shipping of goods for distribution.

After the end of the Brexit transition period the in UK, different rules apply to goods you sell in: (1) Great Britain (England, Scotland and Wales) (“GB”); and (2) Northern Ireland (“NI”).

GB requirements

Products that are not safe are prohibited. Northern Ireland

Please note that different rules will apply in NI from January 1, 2021, as a result of the Northern Ireland Protocol. In particular:

- You should ensure that products meet EU requirements and that you use the CE mark.

- You are an importer if you are established in the EU or NI and you sell products from a country outside of the EU and Northern Ireland (including from GB) into NI. Products sold in NI should be marked with details of any EU / NI based importer.

- Authorised representatives can be based in NI or the EU. From July 16, 2021, new rules come into force under EU Regulation 2019/1020 and some businesses may need to appoint a responsible person in the EU or NI to carry out compliance functions (if there is other entity in the supply chain who is able to carry out the functions). Further guidance on the new rules will be made available by the UK Government.

- If you are using a UK body to carry out mandatory third-party conformity assessment, you will need to apply a UKNI marking as well as a CE mark to products placed in NI from January 1, 2021. Goods with the CE and UKNI marking can’t be sold in the EU. You do not need to use the UKNI marking if you self-certify compliance or use an EU body to carry out a mandatory third-party assessment.

- “Qualifying Northern Ireland goods” will be able to be sold in GB with the CE mark. The UK Government is issuing guidance on how this will work.

The UK Government has released guidance on selling products in the UK and using the UKCA mark. This guidance provides information for manufacturers, importers and distributors regarding compliance requirements from January 1, 2021, including on:
